1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of Advocate Access (the "Service"), operated by Berken Media LLC ("we," "us," "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. What Advocate Access Is
Advocate Access is a free service that helps connect individuals who may qualify for Social Security Disability benefits with independent disability advocates and law firms. We are not a law firm. We do not provide legal advice. We are not your attorney. The advocates and firms we work with are independently licensed in their respective states and are solely responsible for any legal services they provide to you.
3. Eligibility
To use our Service, you must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract. By using the Service, you represent that you meet these requirements.
4. The Eligibility Check
Our eligibility check is an informational tool only. It does not guarantee that you will qualify for Social Security Disability benefits or that any advocate will accept your case. Eligibility for benefits is determined solely by the Social Security Administration based on its own criteria and your complete medical and work history.
5. Advocate Matching
When you complete our eligibility check, we may share your contact information and case details with one matched disability advocate or law firm. You are under no obligation to engage with that advocate or accept their services. Any agreement you reach with an advocate is solely between you and that advocate.
6. No Guarantees
We make no guarantees regarding:
- Whether you will qualify for SSDI or SSI benefits
- The amount of any potential benefit you may receive
- How long any claim or appeal will take
- The outcome of any case handled by a matched advocate
- The performance, conduct, or qualifications of any individual advocate or firm beyond our reasonable vetting process
Average benefit amounts referenced on our site are based on Social Security Administration published data. Individual results vary significantly based on each applicant's work history, earnings, condition, and case-specific factors.
7. Communications
By providing your phone number and email, you agree to receive communications from us and the matched advocate, including by phone (which may use autodialers), text message, and email. Message and data rates may apply. See our TCPA Disclosure for details.
8. User Conduct
You agree not to:
- Provide false, inaccurate, or misleading information
- Use the Service for any unlawful purpose
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any portion of the Service
- Submit information on behalf of someone else without their consent
- Use any automated means (bots, scrapers) to access the Service
9. Intellectual Property
All content on the Service, including text, graphics, logos, and software, is the property of Advocate Access or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
10. Third-Party Links and Partners
Our Service may include links to third-party websites or services, including partner offers shown to applicants who do not qualify for SSDI. We are not responsible for the content, accuracy, or practices of third parties. We may receive compensation when you engage with these third parties, which is disclosed where applicable.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Advocate Access AND BERKEN MEDIA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING LOST PROFITS, LOST DATA, OR PERSONAL INJURY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
13. Indemnification
You agree to indemnify, defend, and hold harmless Advocate Access, Berken Media LLC, and our officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Hamilton County, Tennessee, and you consent to personal jurisdiction in those courts.
15. Changes to Terms
We may update these Terms at any time. The "Last updated" date reflects the most recent changes. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
16. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.
